Terms and Conditions of Engagement – Protection Partners – Reverse Mortgage Referral Service

These Terms and Conditions (Terms) are entered into between Protection Partners Limited NZCN 9414907 (we, us, or our) and you (you or your) in relation to our mortgage referral service (our Services). Together we are referred to as the Parties and each individually as a Party.

1. Acceptance and Eligibility

1.1 You accept these Terms by:

(a) using our online borrowing calculator;

(b) completing our online enquiry or pre-consultation questionnaire; or

(c) booking a consultation through our booking platform.

1.2 You must be 18 years or older to use our services.

1.3 From time to time we may have informal discussions with you, including by telephone, email, or messaging. These discussions are general in nature and do not constitute financial advice unless a formal engagement has been agreed under these Terms or a separate disclosure document.

2. Nature of Our Services

2.1 Protection Partners Limited does not provide financial advice. Our services in connection with this website are limited to:

(a) providing general information about reverse mortgage products offered by Heartland Bank;

(b) providing an indicative borrowing estimate via our online calculator based on information you provide; and

(c) facilitating introductions and referrals to Heartland Bank and/or Stafford Wealth Management Limited where you wish to proceed further or require a financial review.

2.2 The borrowing calculator on this website provides an estimate only. It is based on Heartland Bank's standard lending table and does not constitute a loan approval, credit assessment, or financial advice. Actual borrowing amounts depend on your individual circumstances, property location, condition, and Heartland Bank's credit criteria.

2.3 We are a referral partner of Heartland Bank and Stafford Wealth Management Limited. In connection with referrals we make:

(a) Stafford Wealth Management Limited will invoice Heartland Bank or the relevant referral partner for any referral fee or commission earned (the referral fee is $2,000);

(b) Protection Partners Limited will receive a portion of that fee as a marketing and referral fee; and

(c) this arrangement does not affect the terms or cost of any product you obtain from Heartland Bank or any other referral partner.

2.4 We rely on the accuracy and completeness of the information you provide. You must:

(a) ensure all information provided to us is accurate and complete;

(b) notify us promptly if your circumstances change; and

(c) accept responsibility for any consequences arising from incorrect or incomplete information.

3. Financial Advice Disclosure

3.1 Protection Partners Limited does not hold a financial advice provider licence and does not provide regulated financial advice.

3.2 If you wish to receive financial advice in connection with a reverse mortgage or any other financial product, you will be referred to Stafford Wealth Management Limited or another suitable referral partner. Any financial advice will be provided by that party under their own licence and disclosure obligations.

3.3 Before receiving financial advice from any referral partner, you will be provided with a disclosure statement setting out information about their services, fees, conflicts of interest, and how to make a complaint.

3.4 General information provided on this website, including the borrowing calculator, does not constitute regulated financial advice.

4. No Guarantee of Outcome

4.1 We do not guarantee that:

(a) you will be approved for a reverse mortgage;

(b) the estimated borrowing amount shown by the calculator will reflect the final amount offered by Heartland Bank; or

(c) a reverse mortgage is suitable for your personal circumstances.

4.2 You should obtain independent financial and legal advice before entering into any reverse mortgage arrangement.

4.3 Heartland Bank requires all borrowers to obtain independent legal advice before proceeding with a reverse mortgage.

5. Privacy and Consent to Share Information

5.1 We collect, use, and store personal information in accordance with the Privacy Act 2020 and our Privacy Policy.

5.2 We collect personal information in order to:

(a) respond to your enquiry and facilitate your consultation;

(b) refer your details to Heartland Bank and/or our referral partners; and

(c) comply with legal and regulatory obligations.

5.3 By submitting your details through this website, you acknowledge and agree that we may share your personal information with Heartland Bank, Stafford Wealth Management Limited, or any other referral partner at any time for the purpose of facilitating a reverse mortgage referral or financial review. We are not required to obtain your separate consent each time we share your information with a referral partner.

5.4 We may also share your information with our employees, contractors, and service providers who assist us in delivering our services, and with regulatory authorities where required or permitted by law.

6. Anti-Money Laundering (AML)

6.1 We are required to comply with the Anti-Money Laundering and Countering Financing of Terrorism Act 2009. As part of providing financial advice services, we may be required to verify your identity and collect information about the source of funds.

6.2 We may not be able to provide services until required verification has been completed.

7. Limitation of Liability

7.1 To the maximum extent permitted by law, we are not liable for any loss or damage arising from:

(a) reliance on the borrowing estimate provided by our calculator;

(b) any decision to apply for or proceed with a reverse mortgage;

(c) the terms, conditions, or outcome of any product obtained from Heartland Bank; or

(d) any indirect or consequential loss.

7.2 Nothing in these Terms excludes liability that cannot be excluded under applicable New Zealand law.

8. Intellectual Property

8.1 All content on this website, including the borrowing calculator, tools, and materials, remains our intellectual property or that of our licensors.

8.2 You may not reproduce, copy, or use any content from this website for commercial purposes without our prior written consent.

9. General

9.1 These Terms are governed by the laws of New Zealand.

9.2 If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions continue in full force and effect.

9.3 We may update these Terms from time to time. Continued use of this website following any update constitutes acceptance of the revised Terms.
